Election Dispute of Awadh Bar Association All HC Reaches Supreme Court

Two Advocates of Allahabad High Court at Lucknow have moved to the Supreme Court challenging the Order of Allahabad High Court at Lucknow, regarding election of Awadh Bar Association.

Mr. Amit Sachan and Mr. Alok Tripathi, have filed an SLP before the Supreme Court, challenging the Order dated 24 August and 27 August 2021 of Allahabad HC, whereby some restrictions were imposed in conducting the election of Awadh Bar Association.

The SLP filed before the Supreme Court challenges the jurisdiction of the Court to impose conditions, other than mentioned in the Bye laws of the Awadh Bar Association and also to cancel the entire election process.

It has been harped in the SLP that once the Bar Council of India and UP Bar Council has verified the credential of Advocates and issued COP, then how can a lawyer be barred from contesting election or casting vote in bar association, of which he is member.

Bar Council of UP, Elders’ Committee of Awadh Bar, Returning Officer, Senior Registrar of High Court, Central Bar Association, Lucknow Bar Association, and many other bar associations of Lucknow have been impleased as Respondents

Background

For the year 2021-22, the Elections of Governing Body of Awadh Bar Association were held on 14 August 2021, however on allegation of biasness and unfairness in the election process the Returning Officer cancelled the polling, later that day.

On the next working day, the Division Bench of Justice Ritu Raj Awasthi and Justice D.K. Singh, took suo motu cognizance of the events that occurred on 14 August 2021 and registered a PIL.

On 24 August 2021, the Court passed a detailed order canceling the entire election process and directing it to start afresh from the preparation of the voter list.

Focussing on the principle of “One Bar One Vote” a condition was imposed by the Court was that the Advocate must have filed 20 cases in a year in the last three year, to be eligible to become a valid voter and must not have casted vote in any other bar association.
